ORDER TO RETURN

PETITION BY HUSBAND


An order for restitution of conjugal rights was sought by Lawrence George Malvern Paddy, of Auckland, musician (Mr. Aekins) from Mr. Justice Callan in the Supreme Court yesterday. The petitioner was married to the respondent, Nellie Ellen Paddy, at Wellington, in July, 1929, and they had lived together in Wellington and in Auckland.

Petitioner said his wife left him on Christmas Day, 1933, and had remained away ever since. They had no children. His wife had objected to the late hours which he had to keep as a leader of a dance hand, and said she would go away and earn her own living. She had refused all his requests for her to return.

His Honor issued a decree for restitution of conjugal rights within 21 days of service.
